Welcome to MoltNow, a service operated by TUMI LABS L.L.C-FZ, a company registered in the United Arab Emirates. By using our services, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using MoltNow's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service. These terms constitute a legally binding agreement between you and TUMI LABS L.L.C-FZ.

2. Description of Service

MoltNow provides a 1-click VPS (Virtual Private Server) provisioning service for OpenClaw. Our service includes:

• Automated VPS deployment on cloud infrastructure
• Pre-configured OpenClaw installation
• Secure HTTPS access via Cloudflare tunnels
• Web-based configuration interface
• Remote desktop access to your VPS

3. Account Registration

To use MoltNow, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

MoltNow offers subscription plans billed monthly or annually. By subscribing, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information
• Authorize recurring charges until you cancel

NO REFUNDS: All payments are final and non-refundable. By subscribing, you acknowledge and agree that all fees paid are non-refundable under any circumstances, including but not limited to cancellation, termination, dissatisfaction with the service, or any other reason. Prices are subject to change with 30 days notice.

5. Acceptable Use

You agree NOT to use MoltNow services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute malware, spam, or malicious content
• Attempt to gain unauthorized access to systems
• Engage in cryptocurrency mining without authorization
• Host content that is illegal, harmful, or offensive
• Resell or redistribute our services without permission
• Circumvent any usage limits or restrictions

Violation of these terms may result in immediate termination of your account.

6. API Keys and Third-Party Services

MoltNow integrates with third-party services (LLM providers, messaging platforms, etc.). You are responsible for:

• Obtaining and maintaining valid API keys
• Complying with third-party terms of service
• Any costs incurred from third-party API usage

MoltNow and TUMI LABS L.L.C-FZ are not liable for issues arising from third-party service disruptions or policy changes.

7. AI Actions and User Responsibility

IMPORTANT - PLEASE READ CAREFULLY: OpenClaw is an AI assistant capable of performing actions on your behalf, including but not limited to: sending messages, making bookings, browsing websites, executing commands, sending emails, managing files, and interacting with external services.

YOU ACCEPT FULL AND SOLE RESPONSIBILITY FOR ALL ACTIONS TAKEN BY THE AI ON YOUR BEHALF. By using MoltNow, you acknowledge and agree that:

• All actions performed by the AI are considered to be your own actions
• You are solely responsible for any consequences, damages, losses, or liabilities arising from AI actions
• AI responses and actions may contain errors, inaccuracies, or unintended results
• You must verify and review all AI actions before they are executed when possible
• TUMI LABS L.L.C-FZ and MoltNow bear no responsibility for any bookings, purchases, communications, or other actions made by the AI
• You agree to indemnify and hold harmless TUMI LABS L.L.C-FZ from any claims arising from AI actions

The AI is provided "as is" without any warranties regarding accuracy, reliability, or fitness for any particular purpose. You use the AI at your own risk.

8. Data and Privacy

Your use of MoltNow is also governed by our Privacy Policy. You retain ownership of your data stored on MoltNow servers. We recommend maintaining your own backups. TUMI LABS L.L.C-FZ is not responsible for any data loss.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects access. TUMI LABS L.L.C-FZ is not liable for any damages resulting from service interruptions, downtime, or unavailability.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TUMI LABS L.L.C-FZ expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the service will be uninterrupted, error-free, or secure
• Any warranty regarding the accuracy, reliability, or completeness of AI responses or actions
• Any warranty that the service will meet your requirements or expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUMI LABS L.L.C-FZ, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages
• Any loss of profits, revenue, data, goodwill, or business opportunities
• Any damages arising from AI actions, including bookings, purchases, or communications made by the AI
• Any damages arising from unauthorized access to your account or data
• Any damages arising from service interruptions or unavailability
• Any damages arising from third-party services or API providers

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless TUMI LABS L.L.C-FZ, its directors, employees, partners, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the service
• Any actions taken by the AI on your behalf
• Your violation of these terms
• Your violation of any third-party rights
• Any content or data you submit through the service

13. Termination

You may cancel your subscription at any time through your dashboard. We may terminate or suspend your account for violations of these terms or for any reason at our sole discretion. Upon termination:

• Your VPS instances will be immediately deleted
• You will lose access to all stored data
• No refunds will be provided under any circumstances
• Your obligation to pay any outstanding fees remains in effect

14. Changes to Terms

We reserve the right to modify these terms at any time at our sole discretion. We will notify users of significant changes via email or service notification. Continued use after changes constitutes acceptance of new terms. If you do not agree to the modified terms, you must stop using the service.

15. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and TUMI LABS L.L.C-FZ regarding the use of MoltNow and supersede all prior agreements and understandings.
